Preventative legal measures reduce the risk of costly litigation

Legal fees for the preparation of a will, a contractual agreement or advice on business risk are insignificant when compared to the legal fees incurred to enforce or avoid agreements as a consequence of uncertain or unclear documentation due to poor drafting or contravention of statutory regulation.
At Nicholas O’Donohue & Co. we take careful instruction on each transaction. We indicate areas that need further enquiry, take into account our clients concerns, establish their objectives from the transaction and set out a clearly recommended course. We also provide alternatives [if necessary] and cost estimates for our recommended course of action. While it is not always possible to predict an outcome, we can set in place options to protect the client in circumstances that should an intended transaction come off the rails in the future the initial objective can still be maintained.

Being a generational practice spanning nearly 85 years, clients have gained experience passed down from generations of lawyers working at NODCO, often relating to their own family or business or similar businesses. If a dispute arises, our litigation team will use the legal tools and processes available to endeavour to settle your action promptly by direct negotiations and dispute resolution through mediation or arbitration. If your transaction must be resolved in Court proceedings, your case will be presented in the most cost effective favourable light and where permitted, secure an award of costs against the other party.

Occupational health & safety

Common work place injuries, including stress or anxiety are often overlooked by employers. Checklists for legal compliance are always helpful. An internal audit with a lawyer experienced in workplace injuries and employment prosecutions can limit or avoid potential liability. Injuries at work, in public places and from environment activities have had limits placed on compensation amounts but in most cases compensation is covered by either law or no fault insurance. Know your rights by asking one of our legal health professionals.
